Israel was initially accepted by your organisation on condition it adheres to the 67 borders and on instituting the Right of Return for Palestinian refugees; Neither of these two conditions have been adhered to, and 66 years on, the genocide carries on with the whole world watching supine. How much longer are you going to pretend to be representing the people? How many more have to die before you are spurred into concrete action? It is through your ineffectiveness that the blood of countless innocents taint your hands.

Lawsuit accusing Israel of genocide to be filed in Argentina

“An Argentine lawyer said he will file a lawsuit in federal court in Buenos Aires accusing Israel of crimes against humanity and genocide… the suit will be filed in the coming days in response to Israel’s 50-day operation in Gaza this summer. The suit is in conjunction with the American Association of Jurists… The suit singles out specific Israeli leaders as being responsible both directly and non-directly for the alleged crimes, including Prime Minister Benjamin Netanyahu, Foreign Minister Avigdor Liberman, Defense Minister Moshe Ya’alon, IDF Chief of Staff Benny Gantz and Likud MK Moshe Feiglin.”

John Pilger: Breaking the last taboo – Gaza and the threat of world war

Unlike Netanyahu and his killers, Washington’s pet fascists in Latin America didn’t concern themselves with moral window dressing. They simply murdered, and left the bodies on rubbish dumps. For Zionism, the goal is the same: to dispossess and ultimately destroy an entire human society: a truth that 225 Holocaust survivors and their descendants have compared with the genesis of genocide.

Nothing has changed since the Zionists’ infamous “Plan D” in 1948 that ethnically cleansed an entire people. Recently, on the website of the Times of Israel were the words: “Genocide is Permissible”. A deputy speaker of the Knesset, the Israeli parliament, Moshe Feiglin, demands a policy of mass expulsion into concentration camps. An MP, Ayelet Shaked, whose party is a member of the governing coalition, calls for the extermination of Palestinian mothers to prevent them giving birth to what she calls “little snakes”.

For years, reporters have watched Israeli soldiers bait Palestinian children by abusing them through loud-speakers. Then they shoot them dead. For years, reporters have known about Palestinian women about to give birth and refused passage through a roadblock to a hospital; and the baby has died, and sometimes the mother.

For years, reporters have known about Palestinian doctors and ambulance crews given permission by Israeli commanders to attend the wounded or remove the dead, only to be shot through the head.

For years, reporters have known about stricken people prevented from getting life-saving treatment, or shot dead when they’ve tried to reach a clinic for chemotherapy treatment. One elderly lady with a walking stick was murdered in this way – a bullet in her back.

I was disturbed to read Tali Shapiro’s capable and thorough analysis of the failures of your office to discharge its responsibilities in relation to the prevention of genocide and related violations of international law and applicable human rights conventions, particularly in relation to recent events in Gaza. Ms Shapiro’s analysis is available here:

Ms Shapiro demonstrates carefully and at length the profound inadequacy – if not, indeed, complicity – of the statement from your office of 24 July 2014, which goes to exceptional lengths to maintain a familiar, unconvincing and immoral “balance” amongst parties involved in or affected by the ongoing illegal Israeli occupation and blockade, and the ongoing oppression and persecution of, and discrimination against, Palestinians.

Please add my name to the growing list of people demanding a consistent and morally defensible stance from your office, and an official, urgent, public inquiry into the possibility that Israel is guilty of committing crimes of genocide against the Palestinian people.

Let’s Talk About Genocide: The UN Special Adviser on the Prevention of Genocide Standard and Israel

I’ll be examining only the first seven main pages of the UN Special Adviser on the Prevention of Genocide’s official website, under the assumption that each and every word there is carefully chosen to represent the Adviser’s standard criteria of what Genocide is. As I do this, I will juxtapose Israel with these criteria. I will also be looking into the performance of the Special Adviser on the Prevention of Genocide, as it seems to be in need of internal inquiry.

Israel’s extermination of whole families in Gaza reflects genocidal impulse by Rania Khalek

Eighty-nine families that existed seven weeks ago in Gaza have been exterminated by Israel.

On Sunday 24 August an Israeli missile tore through the home of Issam Jouda in Gaza’s Tal al-Zatar neighborhood east of Jabaliya without warning, killing Issam’s wife Rawiya and their four children—Taghrid, Tasnim, Usama and 
Muhammad.

According to the Palestinian health ministry , the Joudas were the eighty-ninth family wiped out in Gaza since the Israeli army started bombarding the besieged coastal enclave on 7 July.

A ceasefire that took effect on Tuesday evening may stop the flow of blood, but it will not heal the raw wounds of the families of more than 2,100 people killed, nor of the more than eleven thousand injured and 100,000 whose homes were destroyed.

Between 7 July and 21 August, the UN documented 140 families in Gaza partially or completely annihilated by Israeli attacks.

Many were crushed beneath the rubble of their homes. Eight members of the Wahdan family, for instance, were killed in their house in Jabaliya refugee camp after beinginstructed by Israeli forces to stay put.

Others were summarily executed in broad daylight by invading Israeli forces in the catastrophically devastated Shujaiya neighborhood. This was the fate of several members of the Shamaly and al-Areer families according to testimony collected by journalist Max Blumenthal.

The Al Mezan Center for Human Rights has recorded at least 990 people killed inside their homes in Israeli attacks, including 324 children. That’s almost half of all people killed in the Israeli assault.

This is no accident.

To turn a blind eye to Israel’s massacres in Gaza today is to be complicit in Israel’s genocidal attacks against the Palestinian people. As of 2 PM on August 9th, an estimated 1,922 Palestinians have been killed — of whom 448 are children and 235 women — and 7,469 wounded by the Israel since July 7, 2014. At least 86% of casualties are civilians. An estimated 200,000 people are still displaced, of whom 10,000 are pregnant women. 373,000 children are estimated to require psychosocial support.  A conservative estimate of homes destroyed or damaged beyond repair is 65,000. Nineteen ambulance drivers and other medics, nine UNRWA workers and nineteen journalists are among the dead. Israel has targeted hospitals, schools, shelters, NGO offices, fishing boats, universities and mosques. It has destroyed Gaza’s only power plant and only sewage treatment system, and there is fear that sewage may contaminate drinking water. Among recorded war crimes are shooting at children and at fleeing civilians. This is not a war in which civilians are ‘collateral damage’. This is a war in which civilians are the targets.

Academic Paper: Israeli War Crimes in Gaza according to the Rome Statute of the International Criminal Court (ICC) by Prof. Paul De Waart

3.1.1 Genocide
The ICC has only jurisdiction over persons and not over states. The IFFM found no proof that the government of Israel had the necessary genocidal. The committee, however, could not exclude that some individual soldiers may have committed genocide. Their eventual prosecution depends on the possibility to prove that a certain individual acted with genocidal special intent.

By the way, the Genocide Convention, to which Israel is a party, provides for the possibility to submit a violation of the convention to the ICC.  However, in the light of absence of clear evidence that acts of genocide have been committed, the IFFM was unable to recommend that states bring proceedings against Israel under the Genocide Convention.


3.1.2 Crimes against humanity
As for crimes against humanity, the IFFM concluded that the IDF were responsible for murder, extermination, persecution and other inhuman acts during operation Cast Lead. It also concluded that these acts of violence were committed with knowledge of the attack in the sense that the perpetrators knew the conduct was part of a widespread or systematic attack against a civilian population and that they intended to further such an attack.
