Three rights groups file ICC lawsuit against Israel over Gaza ‘genocide’ by Al Jazeera

Three Palestinian rights groups have filed a lawsuit with the International Criminal Court (ICC), urging the body to investigate Israel for “apartheid” as well as “genocide” and issue arrest warrants for Israeli leaders.

The lawsuit, filed on Wednesday by human rights organisations Al-Haq, Al Mezan, and the Palestinian Centre for Human Rights, called for “urgent attention to the continuous barrage of Israeli airstrikes on densely populated civilian areas within the Gaza Strip”, which have killed more than 10,500 Palestinians, almost half of them children, according to Gaza health officials.

… The three groups want arrest warrants to be issued against Israel’s President Isaac Herzog, Prime Minister Benjamin Netanyahu and Defence Minister Yoav Gallant.

The ICC’s Office of the Prosecutor (OTP) opened an official investigation into the situation in Palestine in 2021 after determining that “war crimes have been or are being committed by Palestinian and Israeli actors in the West Bank, including East Jerusalem, and the Gaza Strip”.

Over the last few days, we have witnessed Israel undertaking a crime of genocide against the on the Palestinian people in the besieged Gaza strip. Senior Israeli officials have made statements with genocidal intent and followed them up with actions that deliberately inflict on the Palestinian people conditions of life calculated to bring about their physical destruction, amounting to the crime of genocide as defined in international law. This is not an isolated situation but is an extension of systematic grave injustices the Palestinian people have been subjected to, for over a century.

Palestinian appeal to ICC seen as last hope to ‘bring justice for the victims’ of Israeli violations by Sheren Khalel

Four Palestinian human rights organizations on Wednesday, September 20th submitted their fourth “substantive communication” to the prosecutor of the International Criminal Court. The 700-page evidence file submitted alleges that high-level Israeli civilian and military officials have committed “war crimes and crimes against humanity” in the occupied West Bank, including East Jerusalem… These files of evidence, along with other files made by various groups and individuals, are all taken into consideration by the ICC during its Preliminary Examination.

…The Preliminary Examination is a period in which the ICC Office of the Prosecutor is collecting evidence to establish whether or not there is enough proof that a crime of war, humanity or genocide has been committed in a member-territory of the ICC.
