Intl. community must support ICC’s work; Euro-Med Monitor warns against attempts to obstruct justice by Euro-Med Monitor

Geneva – Amidst Israel’s crimes against the Palestinian people in the 1967 Occupied Palestinian Territory, Euro-Med Monitor expresses concern over frequent reports of political pressure exercised by Israel and its allies aimed at preventing the International Criminal Court (ICC) in The Hague from issuing arrest warrants against senior Israeli security and political figures. 

… The Israeli media has revealed that the Israeli government is holding secret meetings, consultations, and conversations with several of its allies, including the United State, United Kingdom, and Germany, in an attempt to prevent the issuance of the aforementioned arrest warrants and obstruct the Court’s work on the Palestine case.

Simultaneously, efforts have already been made by the US administration to stop the issuance of the orders. 

… The ICC Prosecutor, Karim Khan, must make legal decisions as soon as possible and follow the Court’s procedural rules and rules of evidence in accordance with the Rome Statute.

… The international community, in all its forms, should work to support the Court’s work towards establishing justice in view of Israel’s ongoing failure to uphold its international obligations to prevent and stop serious crimes and grave violations committed against the Palestinian people over the past 76 years. These crimes and violations include war crimes, crimes against humanity, and genocide, while other nations are complicit, given their involvement in maintaining Israel’s illegal ongoing military occupation of Palestine by providing various forms of military, political, financial, and media support and assistance to Israel.

All nations are required to carry out their moral and legal duties; abide by any legitimate requests for arrest or extradition; and work together to apprehend anyIsraeli officials that orders are issued against; i.e. stop them from escaping and quickly turn them over to the ICC, in compliance with all applicable international laws and regulations.

States Parties to the 1949 Geneva Conventions are also required to carry out their obligations under these conventions, which include opening criminal investigations in their national courts using the principle of universal jurisdiction, and apprehending and prosecuting those who violate these agreements in compliance with applicable international law.

Those who survive Israel’s genocidal bombardment may not survive the sight of the death and destruction it leaves behind.

Her family rushed her to the nearest hospital, al-Amal, which ironically translates to “hope”, only to find no hospital and no hope. One of the heroic doctors who remained there declared her dead. She simply could not withstand the anguish. Overwhelmed by grief and despair, Nima had suffered a stroke.

Nima’s husband, Suleiman, and his children struggled to complete the funeral arrangements, to wash the body in the correct way, to find material for a coffin and to reach out to Rabab, Nima’s eldest daughter, who had sought refuge in Rafah.

However, we are asking you to withdraw from Eurovision 2024, to heed the call from Palestinians to boycott the competition due to the participation of Israel. We welcome that you have chosen, along with other participating artists, not to be silent. However, while you say “My heart and solidarity has and will always lie with the oppressed” – by participating in Eurovision you will be standing with the oppressor. Palestinians have called for artists to withdraw from the contest, and if your wish to stand in solidarity is sincere, then you should listen to them. None of us with the privilege of living in safety knows better than Palestinians, a people who are experiencing the most extreme colonial violence, that of genocide, and who for 7 decades, have been subjected to systematic apartheid, occupation, siege, ethnic cleansing, dispossession, mass incarceration and murder. Words from the stage will be meaningless as you will have ignored the Palestinian call to boycott.

‘Obvious Evidence of Genocide’: Mass Grave Discovered in Gaza’s Nasser Hospital by Olivia Rosane

Palestinian civil defense discovered hundreds of bodies buried by Israeli forces in a mass grave inside the complex of Khan Younis’ Nasser Medical Complex on Saturday.

Rescue workers said they had removed at least 200 bodies as of 12:00 pm local time on Sunday, and they estimated that at least another 200 remained, Middle East Eye reported.

“We found corpses without heads, bodies without skins, and some had their organs stolen,” the director-general of the Government Media Office said in a statement shared by Quds News Network

Yet Ann and I were not certain that the final draft of the Genocide Convention does exclude cultural genocide entirely. Pondering Article 2 of the convention—“Causing serious bodily or mental harm to members of the group”—made us interrogate the notion of ‘mental harm’ and the interpretational latitude it offers. We wondered whether it is possible to interpret mental harm as both psychological and cultural, i.e. harm to an individual’s sense of cultural identity in addition to the larger harm to humanity itself.

 In this essay, I will examine “mental harm” as a term that encompasses collective as well as individual suffering through the lens of Israel’s destruction of Palestinian material, cultural and intellectual achievements in 2023-24. Israel/Gaza: UN experts condemn destruction of judicial infrastructure, call for protection of justice operators headed by Margaret Satterthwaite and Irene Kahn

GENEVA (16 April 2024) – UN experts* today called for the protection of justice operators in Israel and condemned the destruction of judicial infrastructure in Gaza.

The experts deplored reports that on 9 October 2023 the Israeli army bombed the building which housed the local headquarters of the Palestine Bar Association, resulting in the destruction of its official archives.

On 4 December 2023, the Israeli army released a video showing the complete blasting of the building of Gaza’s empty courthouse, seized in November 2023.

“The right to a fair trial and access to justice require adequate infrastructure and efficient protection for all actors in the administration of justice, as well as for case files and documentation. We are alarmed by this unnecessary destruction of the judicial infrastructure in Gaza,” the experts said.

Action Alert: Al-Haq, Al Mezan and PCHR Urge the International Community to Intervene as Israeli Forces and Settler Violence Intensifies Across the West Bank

In the midst of Israel’s genocidal attacks in Gaza, Al-Haq, Al Mezan Center for Human Rights and the Palestinian Centre for Human Rights (PCHR) urge the international community, private actors and businesses, to respond to the widespread violent attacks against Palestinians and their property across the West Bank. Violent Israeli military and settler attacks have been escalating in intensity and scale ––between 7 October 2023 and 15 April 2024, as of 12:00 pm, 435 Palestinians, including 112 children, have been killed by Israeli Occupying Forces (IOF), eleven Palestinians, including three children, have been killed by settlers, five Palestinians have been killed by settlers or the IOF and one Palestinian has been killed by a settlement guard in the West Bank, including the eastern part of Jerusalem, according to Al-Haq’s documentation. 

… Like the ongoing assault on Gaza, the current escalation in the West Bank does not take place in a vacuum. Between 1 January and 31 October 2023, there were at least 1,038 incidents of settler violence. Since 7 October 2023, settler attacks have more than doubled from an average of three to eight incidents a day. Similarly, the rate of Palestinians displaced has more than doubled…

Making a Killing? State and corporate commercial ties to genocide in Gaza – and what governments and companies must do to prevent it by Lydia de Leeuw and Max Lamb

In its Principle 7, The United Nations Guiding Principles on Business and Human Rights (UNGPs) provide some further guidance on how a home state – the country in which a company is domiciled – can fulfil this duty. Home states should engage “at the earliest possible stage possible” with companies to help in the identification and prevention of the risk of their activities or business relationships being linked to acts of genocide in Gaza. Additionally, states should deny access to public support and services to companies that are linked to acts of genocide in Gaza and refuse to cooperate in addressing the situation. Finally, home states should ensure that their “policies, legislation, regulations and enforcement measures are effective in addressing the risk of business involvement” in genocide in Gaza. This means, among other things, that states should take effective action to investigate and prosecute companies (where national laws allow) and corporate officials for their involvement in acts of genocide in Gaza.

As Palestinian journalists, we urgently appeal to you, our colleagues globally, with a demand for immediate and unwavering action against the Biden administration’s ongoing complicity in the systematic slaughter and persecution of journalists in Gaza. We insist you publicly boycott the upcoming White House Correspondents’ Dinner on April 27 as an act of solidarity with us — your fellow journalists — as well as with the millions of Palestinians currently being starved in Gaza due to the Biden administration’s continued political, financial, and military backing of Israel and cut-off of funding for live-saving humanitarian aid.
