On June 10, 2024 before a three-judge panel of the Ninth Circuit Court of Appeals, Palestinians from Gaza and Palestinian-Americans with family in Gaza argued that the courts have a constitutional obligation to hear their claims that President Biden, Secretary of State Blinken, and Secretary of Defense Austin violated their legal duty to prevent – and are complicit in – Israel’s genocide in Gaza. The lower court had found a plausible case of genocide and urged the Biden administration to reexamine its “unflagging support” for Israel’s siege of Gaza, but dismissed the lawsuit in January, finding it was not the court’s place to rule on what it determined was a “political question.”

  1. Issam Hajjaj, 27, survived the massacre and spoke to Mondoweiss. “We were running away from bombing and killing. In all directions, there was either bombing, an Israeli tank, or Israeli gunmen shooting at anyone in their path,” he explained. “While we were running away from death, I saw dismembered bodies on the road as a result of the bombing, and I saw those who left their loved ones under the rubble and fled to save the rest of the family.” 
  2. “We did not know from which direction death would come for us.”

Hajjaj says that within minutes of the invasion starting, Israeli forces surrounded the targeted location from all sides and did not leave any route for people to escape except one road, Al-Zuhur Road connecting Nuseirat and Deir Al-Balah. However, just at the same time that the Nuseirat massacre took place, people near Al-Aqsa Martyrs Hospital in Deir Al-Balah were fleeing to Nuseirat, and people were using this street to arrive.

Hajjaj explained that the targeted location was two buildings near Al Awda Hospital in the Nuseirat camp, but to reach these two buildings, the Israeli army destroyed an entire residential square.

Those who were brutally murdered were either going to or coming back from Camp Souk, having their breakfast, playing in the street, going to the Al Awda hospital, cooking food, and visiting relatives and friends, i.e., the timing was chosen carefully in order to kill as many people as possible.

Behind the bars of Israeli prisons, Israel has been waging war against Palestinian prisoners, creating conditions that make the continuation of human life impossible. The effects of this brutal campaign have reverberated among prisoners’ families outside of jail, who are watching their loved ones being systematically starved, beaten, tortured, and degraded.
  2. … Other depravities have been documented in several other prisons, often gloatingly by Israeli news channels who broadcast scenes of the abuse, including degrading treatment, in what can only be described as snuff films. Israeli prison doctors have assisted in the torture of Palestinian detainees, both before and after October 7. Alongside these acts of torture and humiliation, prison authorities have severely restricted prisoners’ food intake to the point of near-starvation, giving 20 prisoners enough food for two people
  3. The picture that emerges is one in which Israeli authorities are putting Palestinians in animal-like conditions calculated to torture, humiliate, and in man cases, to bring about their death.
