Statement of ICC Prosecutor Karim A.A. Khan KC: Applications for arrest warrants in the situation in the State of Palestine on International Criminal Court website

On the basis of evidence collected and examined by my Office, I have reasonable grounds to believe that Yahya SINWAR (Head of the Islamic Resistance Movement (“Hamas”) in the Gaza Strip), Mohammed Diab Ibrahim AL-MASRI, more commonly known as DEIF (Commander-in-Chief of the military wing of Hamas, known as the Al-Qassam Brigades), and Ismail HANIYEH (Head of Hamas Political Bureau) bear criminal responsibility for the following war crimes and crimes against humanity committed on the territory of Israel and the State of Palestine (in the Gaza strip) from at least 7 October 2023: 

  • Extermination as a crime against humanity, contrary to article 7(1)(b) of the Rome Statute;
  • Murder as a crime against humanity, contrary to article 7(1)(a), and as a war crime, contrary to article 8(2)(c)(i);
  • Taking hostages as a war crime, contrary to article 8(2)(c)(iii);
  • Rape and other acts of sexual violence as crimes against humanity, contrary to article 7(1)(g), and also as war crimes pursuant to article 8(2)(e)(vi) in the context of captivity;
  • Torture as a crime against humanity, contrary to article 7(1)(f), and also as a war crime, contrary to article 8(2)(c)(i), in the context of captivity;
  • Other inhumane acts as a crime against humanity, contrary to article 7(l)(k), in the context of captivity;
  • Cruel treatment as a war crime contrary to article 8(2)(c)(i), in the context of captivity; and
  • Outrages upon personal dignity as a war crime, contrary to article 8(2)(c)(ii), in the context of captivity.

On the basis of evidence collected and examined by my Office, I have reasonable grounds to believe that Benjamin NETANYAHU, the Prime Minister of Israel, and Yoav GALLANT, the Minister of Defence of Israel, bear criminal responsibility for  the following war crimes and crimes against humanity committed on the territory of the State of Palestine (in the Gaza strip) from at least 8 October 2023:

  • Starvation of civilians as a method of warfare as a war crime contrary to article 8(2)(b)(xxv) of the Statute;
  • Wilfully causing great suffering, or serious injury to body or health contrary to article 8(2)(a)(iii), or cruel treatment as a war crime contrary to article 8(2)(c)(i);
  • Wilful killing contrary to article 8(2)(a)(i), or Murder as a war crime contrary to article 8(2)(c)(i);
  • Intentionally directing attacks against a civilian population as a war crime contrary to articles 8(2)(b)(i), or 8(2)(e)(i);
  • Extermination and/or murder contrary to articles 7(1)(b) and 7(1)(a), including in the context of deaths caused by starvation, as a crime against humanity;
  • Persecution as a crime against humanity contrary to article 7(1)(h);
  • Other inhumane acts as crimes against humanity contrary to article 7(1)(k).

ICC Prosecutor Completely Neglects to Mention the Crimes Committed Against Palestinian Prisoners in Arrest Warrants for Israeli Officials by Addameer

On May 20, 2024, the Prosecutor of the International Criminal Court (ICC) announced that he had requested arrest warrants for two high-profile Israeli officials, Prime Minister Benjamin Netanyahu and Security Minister Yoav Gallant. The Prosecutor stated that he had reasonable grounds to believe that Netanyahu and Gallant had committed war crimes and crimes against humanity in Gaza from at least October 8, 2023. The decision made by the ICC Prosecutor to hold Israeli officials accountable for their crimes marks a significant step towards ending decades of impunity for crimes committed in occupied Palestine. This decision underscores the importance of international justice in addressing long standing oppressions and human rights violations.

Addameer welcomes the decision of the ICC Prosecutor’s Office; however, substantial efforts are still required to achieve comprehensive justice and hold Israeli officials fully accountable for their crimes. 

… Addameer also documented a worrying increase in the acts of torture committed against Palestinian detainees since the beginning of the genocide. Palestinians are systematically victim of torture and mistreatments during their arrest, interrogation, and while in detention. Detention conditions are deteriorating, including with the provision of extremely poor food portions, forcing detainees to sleep in very cold cells, overcrowding of cells, and detainees having to sleep on the floor. Palestinian detainees are subjected to beatings multiple times a day, sometimes until loss of consciousness, forced to stay in stress positions, threatened, including with death, sexual violence, or threats on their families, and regularly strip searched.

… Israeli nationals committing crimes against Palestinian detainees are never prosecuted by the Israeli occupation authorities. According to the Public Committee Against Torture in Israel (PCATI), more than 1,400 complaints of torture  were submitted to the what so called Israeli Ministry of “Justice” since 2001 and all the cases were closed without a single indictment.

… Addameer strongly encourages the Office of the Prosecutor to investigate the aforementioned crimes and issue arrest warrants for those responsible… Failing to investigate and prosecute Israeli perpetrators of such crimes will only reinforce injustice and the system of complete impunity created by the occupying state.

Israel’s extortion leaflets and Namecheap: How to do corporate accountability during a genocide by Tali Shapiro

The leaflets, like much of Israel’s abuse of technology during this genocide, included a QR code leading to a website with more ominous messaging, a snitch box, and a countdown until presumably the threat of outing will be acted upon.

An anonymous group has traced the website to the domain registration company NameCheap, and upon discovering that the company terminated their Russian accounts because of “war crimes and human rights violations,” wrote a letter (text below) demanding similar treatment in this case, stressing the possibility of complicity in war crimes, collective punishment, and genocide.

I am beginning to have fewer dreams. Or nightmares; I am unsure what the most accurate description is. I no longer have a normal sleep pattern—most nights, I am scrolling or stationed in front of satellite news reports, watching a tomorrow that has yet to begin where I live unfold its horrors on our people. I have kept this meager vigil for seven months, trying to absorb every fact and detail of the genocide in Gaza. Poet Fady Joudah writes of our dead, “I am a grief capitalist, I claim them all.” While grief animates my vigil, so does distrust. I know not to trust the record-keeping. I watch our deaths disputed, I watch the months, years, crimes, and devastations of seventy-six years that predate October 7th, 2023, erased before my eyes.

Palestinian NGOs Urge ICC to Intervene to Prevent Genocidal Massacre in Rafah, Issue Arrest Warrants for Israeli War Cabinet Members by Al Mezan Center for Human Rights, Al-Haq, and the Palestinian Centre for Human Rights

We have closely followed the attacks aimed at you, your Office, the Court, its personnel, and family members, including threats of retaliation, with deep concern. We are dismayed and vehemently condemn any attempt to undermine the independence of the Court and its crucial ability to fulfill its mandate. These attacks are intended to perpetuate Israel’s decades-long enjoyed impunity for the most serious international crimes in Palestine, as Israel entrenches its settler colonial apartheid regime, and annexes more territory.  

Despite the challenges posed by these attacks, it is crucial that justice is upheld and that the Rome Statute’s assertion that “the most serious crimes of concern to the international community as a whole must not go unpunished” is honored. We will continue to support and engage with the Court and your Office and will continue to urge states parties to the Rome Statute to abide by their obligations to cooperate fully with the Court, respect and ensure respect for its integrity and independence, and publicly reject and condemn acts or threats committed against the administration of justice. 

… Israel’s actions evidence a blatant disregard for international law and human rights principles, as exemplified by its deliberate refusal to abide by United Nations (UN) Security Council, UN General Assembly, and UN Human Rights Council resolutions, as well as the provisional measures orders issued by the International Court of Justice (ICJ). The Israeli war cabinet’s unanimous decision to proceed with the Rafah ground invasion demands one unequivocal response: the immediate issuance of arrest warrants for all its members, particularly those with decision-making powers—Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant, and Minister and former Chief of Staff Benny Gantz. We note that all three of them are also implicated in international crimes preceding the ongoing genocide, for which arrest warrants could and should have been issued long ago.

Arrest warrants should also be issued for commanders and soldiers from the Israeli military units currently participating in the Rafah ground invasion, including those affiliated with the 162nd Division, particularly the 401st Armored Brigade, which had taken operational control of the Palestinian side of the Rafah border crossing, and the 215th Artillery Brigade. This action is imperative to hold accountable those involved in ordering and perpetrating acts that constitute international crimes under the Rome Statute, including the crimes against humanity of extermination and forcible transfer, and the crime of genocide.

One of the first posts on @GazaMedicVoices, a social media page that provides firsthand accounts from healthcare workers on the ground in Gaza, was shared on October 12, 2023. It presented the testimony of a consultant surgeon in Gaza, dated to just three days into Israel’s extermination campaign—before, to many, it was recognizable as such. “Having spent five days without leaving the hospital, I find myself at a loss for words,” the surgeon pleaded. “Never before in my entire life have I witnessed anything like this, and I am unable to articulate what I have seen. I am left speechless.”

Given the massive military aid that Israel receives from USA and given Israel’s highly equipped IDF it’s unmet stated military objectives should be discerning for the Israeli leadership. Rather, it seems quite apparent from the patterns identified in this report and by the price of thousands of civilian deaths and 80 years’ worth of destruction and debris, that Israel’s likely actual military objective was to cause mass ‘extermination’ (labelled as such because Israel clearly sees Palestinians as less than human with senior administration using terms such as ‘human animals’) and mass expulsion– policies of violent colonisation and occupation… The Gaza civilian population is in risk of starvation, forced displacement to a third country and of further attacks whilst Government(s) do not recognise the Israeli strategy of attacks on Gaza…

War on Gaza: Israel kills hundreds of imams offering message of hope and patience by Abubaker Abed

Around 300 Islamic scholars and sheikhs, including Quran instructors, Islamic preachers, and imams, have been killed so far in the military assaults, according to the Palestinian Ministry of Religious Affairs. 

Meanwhile, more than 500 mosques have been completely flattened, and dozens of mosques have been partially destroyed, including the historic Al-Omari Mosque.

Three churches have also been reduced to rubble, including the historic Church of Saint Porphyrius. The ministry’s main building and the Quran Podcast Institute were also struck and damaged by Israeli raids. 

… A ministry spokesperson said that Israel’s targeting of mosques and Muslim scholars is “a deliberate act aimed at breaking the faith of Palestinians. We call on especially the Islamic scholars and ministries in the Arab world to seriously act and stop the ongoing atrocities against our people.”


“Our message to the world is that we want you to stand with us, protest to provide protection for innocent civilians, and stop the genocide in Gaza,” they added.

Eurovision 2024: The beloved contest has become an ugly mess on DAZED

This year Eurovision’s mantra ‘united by music’ rings hollow as the European Broadcasting Union doubles down on including Israel in this year’s contest.

… in 2022, following outcries from artists and international broadcasters, the European Broadcasting Union (EBU) made the decision to disqualify Russia from the song contest following the country’s invasion of Ukraine. In a statement at the time, the EBU said that based on meetings with Eurovision’s governing body, the rules of the event and “the values of the EBU… [that] the inclusion of a Russian entry… would bring the competition into disrepute”. Such sentiments sour when considering the EBU’s attitude towards Israel and the organisation’s failure to consider experiences of those living in Palestine. It’s baffling that Russia’s assault on Ukraine is considered the antithesis of what Eurovision stands for but an ongoing genocide is permissible.

Israel) for the protection of the Palestinian people in Gaza from grave and irreparable violations of their rights, and of South Africa’s rights, under the Convention on the Prevention and Punishment of the Crime of Genocide (‘Genocide Convention’), as a result of Israel’s ongoing military assault on Rafah.
