Reading the ICC Prosecutor’s statements on Palestine from the Global South by Abdel Ghany Sayed

As predicted, the International Criminal Court prosecutor has applied for arrest warrants to be issued against “both sides” in the situation[1] in Palestine.

…Not unlike the International Court of Justice proceedings where Israel is being accused of genocide, what is “historic” is not how the international legal institution is reacting to Palestinian suffering; it is rather the extreme suffering and criminality that force such institutions to act.

…Israeli officials’ conduct has resulted in two million direct and indirect victims. Their conduct provides a rare example satisfying each possibility that may alone manifest the temporal and geographical aspects of the scale factor. 

…The offenses by or as a result of the conduct of Israeli statesmen include wilful killing and wounding, torture and ill-treatment, rape, starvation, wanton destruction, displacement and unlawful confinement and hostage-taking. These satisfy the “nature” factor and top any conduct by other actors within the Palestine situation, both quantitatively as well as qualitatively.

On the “manner of commission” factor, the Office has ignored the “particular cruelty” demonstrated in the reports concerning sexual violencetorture and summary execution, and the videos that Israeli soldiers post routinely documenting their appalling crimes.

On the “impact” factor, the amount of terror inflicted on the entire population of Palestine is of significant gravity when compared with anything happening in the entire world.

International community must act immediately to stop Israeli army’s massacre of Palestinians at Al-Shifa Hospital on Euro-Med Human Rights Monitor

  • A survivor who asked to be identified only as “M.K.” confirmed that Israeli soldiers repeatedly took prisoners into the hospital’s morgue area, that gunshots were then heard, and that the soldiers left without the prisoners… Another witness, who preferred to remain completely anonymous due to safety concerns, and who was able to leave Al-Shifa Medical Complex recently, confirmed to the Euro-Med Monitor team that he witnessed Israeli forces taking eight or 10 Palestinian civilians at a time towards the morgue area. He then heard heavy gunfire, and the Israeli forces later left without the civilians. 
  • These civilians were likely subjected to unlawful killings and executions, as all the information obtained by Euro-Med Monitor’s field team suggests that since Al-Shifa Medical Complex was restored on Sunday/Monday night, 100 Palestinians were killed by Israeli gunfire in and outside of it.
  • The Israeli army has acknowledged that it killed 90 people during the ongoing military operation in Al-Shifa Medical Complex. An international committee must be established to investigate the war crimes and crimes against humanity committed by Israeli forces as part of its genocide campaign, which includes planned killings and executions against civilians that are outside the purview of the law and judiciary.

Israeli forces kill four Palestinians within 48 hours by International Solidarity Movement

Hatem Abed Hafez Shalludi is now the fourth Palestinian that has been killed by Israeli soldiers within the last 48 hours. Israeli soldiers committing extrajudicial killings of Palestinian civilians is nothing new under the sun.
This is yet another face of Israeli colonialism and the continuous genocide of Palestinian civilians living under occupation.

Human Rights Council discusses human rights situation in Palestine and other occupied arab territories discussion at the United Nations Human Rights Council

PLEASE TAKE ACTION RIGHT NOW AND SEND YOUR LETTER TO THE UN OFFICE OF THE SPECIAL ADVISER ON THE PREVENTION OF GENOCIDE AND THE INTERNATIONAL CRIMINAL COURT PROSECUTOR.

International-Lawyers.org said that the most fundamental human rights were being violated, and there was an extraordinary number of summary executions, as well as mass arbitrary imprisonment, including denial of food and water.  The repetition of those actions over a long period of time was evidence of the intention to commit the crime of genocide.  The Human Rights Council and Special Procedures were urged to investigate Israeli authorities to determine if those actions constituted the crime of genocide.

Let’s Talk About Genocide: Shoot to Kill – Israel’s New Phase of Genocidal Policy by Tali Shapiro

Beyond the particularities of this bloody episode, there is also the wider context of the crime of genocide, which I discuss at length in the “Let’s Talk About Genocide” series [Parts 1, 2, 3, 4, 5, 6]. My analysis stems from the assumption that Palestinians are in a reality of a continuous genocide, according to the Convention of Prevention of Genocide, with recurring peaks of violence (last summer’s bombing of Gaza to the effect of 6 nuclearbombs, murdering 2300 people, including over 500 children, is one harrowing example) that induce heightened acts of resistance. The mechanisms of genocide that are in place are not put on hold because the victims of the genocide killed members of the population that benefit from the genocide. These uncoordinated stabbings are a gut response to the continuous extermination.

A secret CIA review published recently by WikiLeaks reveals that Israel has been among the least successful countries regarding the targeted killing of opponents, Lebanese newspaperAl-Akhbar reported on Thursday… The review, Al-Akhbar continued, does not go into the details of the programme’s failures. However, for anyone well-versed in what is more than half a century of the incremental genocide of the Palestinians by Israel, the answer is very clear.

5.5 INTERNATIONAL CRIMINAL LAW
Individuals, including military personnel and law enforcement officers, can be held criminally
responsible for certain violations of international human rights law and international humanitarian
law.
Under the principle of universal jurisdiction, all states have an obligation to investigate and, where
enough admissible evidence is gathered, prosecute crimes under international law, including
genocide, crimes against humanity, war crimes, torture, extrajudicial executions and enforced
disappearances.
