Statement of ICC Prosecutor, Fatou Bensouda, respecting an investigation of the Situation in Palestine

Today, I confirm the initiation by the Office of the Prosecutor (”Office”) of the International Criminal Court (”ICC” or the ”Court”) of an investigation respecting the Situation in Palestine. The investigation will cover crimes within the jurisdiction of the Court that are alleged to have been committed in the Situation since 13 June 2014, the date to which reference is made in the Referral of the Situation to my Office.

ICC judges order outreach to victims of war crimes in Palestine by Ali Abunimah

Please TAKE ACTION RIGHT NOW and send your letter to the UN Office of the Special Adviser on the Prevention of Genocide and the International Criminal Court Prosecutor.

On Friday, the ICC’s Pre-Trial Chamber 1 ordered court administrators to establish “a system of public information and outreach activities for the benefit of the victims and affected communities in the situation in Palestine.”

The Pre-Trial Chamber is a panel of judges that supervises how the ICC prosecutor’s office carries out its investigative and prosecutorial activities. It has the responsibility to guarantee the rights of suspects, victims and witnesses during investigations by the prosecutor.

The court will also create a page on its website “especially directed to the victims in the situation in Palestine.”

The decision facilitates the gathering of evidence that could be used in indictments or trials of suspected war criminals.

Despite Israel’s Repeated Genuine Unwillingness to Carry Out Investigation and Prosecute Perpetrators, International Criminal Court Prosecutor, Fatou Bensouda, in Contravention of ICC Mandate, Accepts the Perpetrator’s Official Positions, and Still Won’t Initiate an Investigation

Violence against civilians – in a situation such as the one prevailing in Gaza – could constitute crimes under the Rome Statute of the International Criminal Court (“ICC” or “the Court”), as could the use of civilian presence for the purpose of shielding military activities.

I remind all parties that the situation in Palestine is under preliminary examination by my Office. While a preliminary examination is not an investigation, any new alleged crime committed in the context of the situation in Palestine may be subjected to my Office’s scrutiny. This applies to the events of the past weeks and to any future incident.
