Palestinian Organizations Welcome Statement by ICC Prosecutor, and Reiterate the Need for Immediate Issuance of Arrest Warrants by Al Mezan, Al-Haq, and Palestinian Centre for Human Rights (PCHR)

  • Al Mezan, Al-Haq, and Palestinian Centre for Human Rights (PCHR) welcome the recent statement made by the Prosecutor of the International Criminal Court (ICC), Karim A. A. Khan KC, concerning the reported impending expansion of the ground offensive by Israeli forces in Rafah and the recurrent bombardments of the area. Our organizations emphasize that while this statement is significant, the catastrophic conditions faced by 2.3 million Palestinians in Gaza demand concrete action… particularly the issuance of arrest warrants against individuals implicated in these crimes. Specifically, we call for the issuance of arrest warrants against the Israeli Prime Minister, who ordered the expansion of the ground invasion into Rafah, the Israeli Defense Minister, and the Chief of Staff of the Israeli military, who are responsible for grave violations of international law.
  • The issuance of arrest warrants is a necessary step towards ensuring justice and accountability for the victims of these crimes, and deterring and preventing the commission of further crimes. We urge the ICC to expedite the process of issuing these warrants and to pursue all necessary measures to hold those responsible for war crimes, crimes against humanity, and the crime of genocide accountable for their actions.

  • PRETORIA, South Africa (AP) — Israel has ignored the ruling by the U.N.’s top court last week by killing hundreds more civilians in a matter of days in Gaza, South Africa’s foreign minister said Wednesday, adding that her country has asked why an arrest warrant for Israeli Prime Minister Benjamin Netanyahu has not been issued in a case South Africa filed at the separate International Criminal Court.
  • … The preliminary ruling by the U.N.’s International Court of Justice in South Africa’s case accusing Israel of genocide in Gaza ordered Israel to do all it can to prevent death, destruction and any acts of genocide against Palestinians in the territory.
  • “I can’t be dishonest. I believe the rulings of the court have been ignored,” South Africa’s foreign minister said. “Hundreds of people have been killed in the last three or four days. And clearly Israel believes it has license to do as it wishes.”
  • Pandor said there was a danger of the world doing nothing to stop the civilian casualties in Gaza and said similar inaction contributed to the horrific death toll in the genocide in Rwanda in 1994, when more than 800,000 people were slaughtered in the East African country.

The ICC Prosecutor’s Double Standards in the Time of an Unfolding Genocide by Triestino Mariniello

  • Favouring the ICC’s ‘cordial relationship’ with the United States over the fulfilment of its mandate would further tarnish the Court’s image as an independent and impartial institution. Yielding to pressure from powerful states would result in further legitimacy costs for an institution that, so far, has failed to hold anyone to account in some of the most widely-documented situations of alleged international crimes, such as Iraq, Afghanistan, and Palestine. Carrying on with such double standards when faced with an unfolding genocide would mean failing the final test bench for the credibility of the Court. It would confirm the reasons underpinning the growing disillusionment in international criminal justice project in the Global South. The increasing calls for the establishment of an hoc tribunal in Gaza, including by UN senior officials, prove that the ICC’s failure to hold to account those responsible for the most serious crimes in the Palestine situation would constitute a serious challenge to the existence of the entire international justice system set up under the Rome Statute.

Yesterday I attended a session called by Palestine at the United Nations in Geneva. Over 120 states attended. While the formal session consisted of statements of national position with few surprises, I was able to discuss with a large number of delegates in the corridors why the Genocide Convention has not been activated triggering a reference to the International Court of Justice.

The answer is now clear to me. It is not that people are worried that a claim of genocide will not be successful at the International Court of Justice. It is that everybody is quite sure it will succeed. There is no respectable argument that this is not a genocide in the terms outlined above.

The problem is that once the ICJ has determined that this is a genocide, it follows that not only are Netanyahu and hundreds of senior Israeli officials and military personally liable, but it is absolutely plain that “Genocide Joe” Biden, Sunak and members of their administrations are also criminally liable for complicity, having provided military support for the genocide.

The International Criminal Court cannot ignore a judgment of genocide from the International Court of Justice and will have no choice but to issue arrest warrants.
