“Also thus far left out of the ICC lense is ethnic cleansing. Yugoslav ethnic cleansing policies were the basis of indictments in the criminal court on the former Yugoslavia, in 2001, 1995. And the ICTY ruled that acts of ethnic cleansing, such as the Srebrenica massacre in 1995, were genocide. In the Bosnia case against Serbia and Montenegro, the International Court of Justice ordered provisional measures agains Yugoslavia for reparations for its ethnic cleansing policies. These cases are relevant for Palestine, but are nowhere on the horizon for the massive forcible displacement and population transfer, suffered by Palestinians for over 70 years, in the current ICC investigation and war crimes framework.”
