The JIMENA statement also ignores the crimes of Zionism towards Mizrahi Jews. The most striking example is the institutional kidnapping of thousands of Mizrahi (mostly Yemeni) babies from their families. Other examples abound. When Jews from Muslim countries arrived in the nascent Israeli state in the 1950s, they encountered the racism of the Zionist institutions that established an Ashkenazi hegemony. Mizrahi migrants were treated differently than their Ashkenazi counterparts. After the Nakba (نكبة), which means “catastrophe” in Arabic and refers to the destruction of the Palestinian villages and cities and displacement and genocide of Palestinian people in what became the State of Israel, the now-vacant land was in the hands of the Israeli state. While European Jewish migrants were settled in central metropolitan areas and given housing by the state with the prospect of ownership, Mizrahi Jewish migrants were settled on frontier border areas, in underfunded public housing, in order to bolster the Zionist claim to the land of dispossessed Palestinians, and secure the border against invasion.

The siege and what Israeli historian Ilan Pappe calls the “incremental genocide” of two million in the Gaza ghetto; the ceaseless theft of our lands and forcible displacement of our communities, particularly in Jerusalem, the Jordan Valley and the Naqab (Negev); the endless colonial settlements; and the overarching apartheid system that relentlessly reminds us that we, the indigenous people of the land, can only achieve freedom, justice or equality after ending this ruthless Israeli regime of oppression.

What you need to know about the ICC Investigation of war crimes in occupied Palestine by Romana Rubeo and Ramzy Baroud

The ‘narrow scope of the investigation’ has thus far excluded such serious crimes as crimes against humanity. According to the Gaza legal team, the killing of hundreds and wounding of thousands of unarmed protesters participating in the ‘Great March of Return’ is a crime against humanity that must also be investigated.

The ICC’s jurisdiction, of course, goes beyond Bensouda’s decision to investigate ‘war crimes’ only.

Article 5 of the Rome Statute – the founding document of the ICC – extends the Court’s jurisdiction to investigate the following “serious crimes”:
(a) The crime of genocide
(b) Crimes against humanity
(c) War crimes
(d) The crime of aggression

It should come as no surprise that Israel is qualified to be investigated on all four points and that the nature of Israeli crimes against Palestinians often tend to, constitute a mixture of two or more of these points simultaneously.

Both Palestinians and Native Americans have been subjected to genocidal settler-colonial regimes; nevertheless, partly because of their resiliency, neither are extinct, as the myth would have us think. As Steven Salaita observes, that assumption persists in the belief that “Natives have been permanently dispossessed or exist as ahistorical monuments of conquest unable to access modernity, if they exist at all.” Because of this notion, Salaita warns, Palestinian activists might be tempted to use Natives as a model for a “tragic fate” that they do not want themselves. However well-intentioned, as Lujan-Grisham seemed, her statement reinforces what Salaita calls “an ongoing colonial erasure of Indigenous people” both within our borders and beyond.

Israeli leaders brazenly and sadistically, overtly and covertly, carry out their matrix of control, securitization, and incremental genocide. This article raises the question of guilt. Eyal Weizman [3] explores the moral depravity wherein a lesser evil is justifiable if it prevents a greater evil. Michael Ignatieff, human rights scholar and once the leader of Canada’s Liberal Party, defended the use of torture on this basis, and also said that he did not lose sleep over Israel’s massacre of 57 people, including 37 children, in the Lebanese village of Qana in 2006. Israel has bombed, with impunity, the entire life-sustaining infrastructure of Gaza, and unless the siege is entirely dismantled, there are many warnings that the Covid-19 pandemic could well be a holocaust.

Palestine’s population in the West Bank and Gaza is over 5 million people. As previously stated, since the year 2000, over 10,000 Palestinians have been brutally murdered by Israel’s army and settlers, funded exclusively with hard earned U.S. tax dollars. To extrapolate, that means that between the year 2000 and 2020,  660,00 American citizens would have been murdered.
Would we allow such a genocide?
