This brief is in part a direct response to an attempt to pinkwash the Muslim Travel Ban. Language included in the Ban says it will protect Americans by barring entry to “those who would oppress Americans of any race, gender, or sexual orientation” [Human Rights First]. This insinuates that people living in Muslim-majority countries are queerphobic and transphobic, a marketing and political tool most infamously being used by Israel to justify Palestinian genocide.

Einstein and the ghost of Herut 70 years on by Ramzy Baroud

Albert Einstein, along with other Jewish luminaries, including Hannah Arendt, had a letter published in The New York Times on December 4, 1948. That was only a few months after Israel had declared its independence and as hundreds of Palestinian villages were being demolished after their inhabitants were expelled. The letter denounced Israel’s newly founded Herut party and its young leader, Menachem Begin… In the letter, Einstein and his co-signatories described Herut (“Freedom”) as a “political party closely akin in its organization, methods, political philosophy and social appeal to Nazi and fascist parties.”

… On April 19, Israel celebrated its independence day. The “Nazi and fascist” mentality that defined Herut in 1948 now defines the most powerful ruling class in Israel. Israel’s leaders speak openly of genocide and murder, yet they celebrate and promote Israel as if it was an icon of civilization, democracy and human rights.

I think the response from the Netanyahu government reflects a kind of almost delusional arrogance that has been seen before, but rarely this starkly. They believe they are above all international law and they have a total indifference to world opinion. And Avigdor Lieberman, the defense secretary stated that nobody in Gaza was innocent. A normal government would not openly state something that is tantamount to an admission that Palestinians are meant to be eliminated.

Even if I don’t conquer Gaza right now, [conquering it] is part of my ability to settle the Land of Israel, so it is also a part of the mitzvah of conquering the Land. And therefore it follows, there’s no other way; like, we’d have to kill them all. Because this is the difference between the Law of the Persecutor and mitzvah wars. […] A mitzvah war of conquering the Land, which is not limited to saving the people of Israel from their enemies, according to some of the Rishonim [***] I could, on the face of it and by the essential law, destroy, kill and cause to perish [****] all of them. I will not do so, because if I were to do so, and reject international treaties, then the State of Israel shall parish, unless we shall witness a miracle of miracles – and one must not trust in a miracle. Contextualizing the Great March of Return by Haidar Eid

In the last 10 years, Israel has launched three massive genocidal wars of aggression on the occupied Gaza Strip, many of our civilians were massacred by its indiscriminate bombing, condemned by UN experts and leading human rights organizations as war crimes and “possible” crimes against humanity. These assaults left over 3,800 Palestinians dead, predominantly civilians, of whom hundreds were children. Another 15,000 Palestinians were injured. We, the 2 million Palestinians in the besieged Gaza Strip, the overwhelming majority of whom are refugees who were violently expelled and dispossessed from our homes by Zionist forces in 1948, were subjected to three weeks (2009), 2 weeks (2012) and 51 days (2014) of relentless Israeli state terror, whereby Israeli warplanes systematically targeted civilian areas, reduced whole neighborhoods and vital civilian infrastructure to rubble and destroyed scores of schools, including several run by UNRWA, where civilians were taking shelter. This came after years of an ongoing, crippling, deadly medieval Israeli siege of Gaza, a severe form of collective punishment described by Richrad Falk, former UN Special Rapporteur for Human Rights as “a prelude to genocide.”

Despite Israel’s Repeated Genuine Unwillingness to Carry Out Investigation and Prosecute Perpetrators, International Criminal Court Prosecutor, Fatou Bensouda, in Contravention of ICC Mandate, Accepts the Perpetrator’s Official Positions, and Still Won’t Initiate an Investigation

Violence against civilians – in a situation such as the one prevailing in Gaza – could constitute crimes under the Rome Statute of the International Criminal Court (“ICC” or “the Court”), as could the use of civilian presence for the purpose of shielding military activities.

I remind all parties that the situation in Palestine is under preliminary examination by my Office. While a preliminary examination is not an investigation, any new alleged crime committed in the context of the situation in Palestine may be subjected to my Office’s scrutiny.
